1. Agreement to Terms

By accessing or using Canvas Memories (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

Canvas Memories reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Content License and Usage Rights

2.1 Order Fulfillment License

By submitting photos, images, or other content (“Content”) to Canvas Memories, you grant us a non-exclusive license to use, reproduce, modify, and create derivative works from your Content for the purpose of:

• Creating your custom artwork and fulfilling your order
• Internal quality assurance, support, moderation, fraud prevention, and improving our service
• Transmitting your Content to third-party processors we use to generate previews, host files, print products, and operate the service

This license is limited to what is necessary to provide the service you requested. We do not use your photos for marketing, advertising, or public display without your explicit consent.

This may include manual review by authorized team members, internal tools, and service providers when needed to fulfill an order, investigate failures, enforce these Terms, or protect the Service.

2.2 Featured Customer Program (Opt-In Only)

During checkout, you may choose to opt in to our Featured Customer Program. If you opt in, you grant us permission to use your before/after transformation on our website, social media, and promotional materials. In exchange, you receive a discount code for your next order. This is entirely optional and you can request removal at any time by contacting support@canvasmemory.com.

2.3 Your Representations

You represent and warrant that:

• You own or have the necessary rights, licenses, and permissions to submit the Content
• Your Content does not infringe any third-party intellectual property rights
• You have obtained consent from any individuals depicted in the Content
• Your Content does not violate any applicable laws or regulations

2.4 Prohibited Content

You agree not to submit Content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Contains nudity, sexually explicit material, or graphic violence
• Infringes on copyrights, trademarks, or other intellectual property rights
• Contains personal information of minors without parental consent

2.5 Safety and Provider Restrictions

We may use third-party AI or image processing providers to generate previews or fulfill parts of the Service. Those providers may apply their own safety, moderation, or policy rules. We may refuse, remove, or stop processing Content that violates these Terms, violates provider rules, or otherwise creates legal, safety, or operational risk.

Please do not upload nude, sexually explicit, or otherwise highly sensitive images. If you submit Content through a restore, share, or download link, anyone who has that link may be able to access the related file while the link remains active.

3. Service Description

Canvas Memories provides custom artwork creation services, transforming customer photos into artistic renditions printed on various media (canvas, posters, metal prints, etc.). We use professional design tools and printing services to create your custom artwork.

Upload your photo, choose an art style, and see a free preview of your artwork before paying. If you love it, select your product type and size, then complete payment. We print and ship your order. Shipping is on us.

4. Pricing and Payment

Prices are displayed in your local currency (USD, CAD, GBP, EUR, or AUD) and include the cost of artwork creation, printing, and shipping on us. Sales tax may apply based on your location.

Payment is processed securely through Stripe. By providing payment information, you authorize us to charge the total amount shown at checkout.

5. Satisfaction Guarantee

5.1 Artwork Satisfaction

You see a full preview of your artwork before paying. You can try multiple styles for free. If you've placed an order and are not satisfied with the final product, contact us within 30 days of delivery and we'll work with you to make it right or provide a full refund.

5.2 Print Quality Issues

If your print arrives damaged or has quality defects, contact us within 30 days of delivery. We'll reprint it free of charge or provide a full refund. Please provide photos of the issue.

5.4 What's NOT Covered

• Subjective preferences after approving the artwork
• Color variations due to screen calibration differences
• Minor artistic interpretations inherent to the transformation process
• Damage caused by improper handling or display

6. Shipping and Delivery

We ship to the United States, Canada, United Kingdom, European Union, and Australia. Shipping on us is included on all orders. Metal prints ship to US addresses only.

Processing Time: 3-5 business days for artwork creation and printing

Shipping Time:

• Standard: 5-10 business days
• Rush: 2-5 business days (where available)

We are not responsible for delays caused by shipping carriers, customs, or events beyond our control.

7. Cancellations and Refunds

7.1 Before Production

You may cancel your order before we begin production for a full refund. Contact us immediately at support@canvasmemory.com.

7.2 After Production Begins

Once production begins, orders cannot be cancelled. However, our satisfaction guarantee (Section 5) still applies.

7.3 Refund Processing

Approved refunds are processed within 5-7 business days to your original payment method.

8. Intellectual Property

The Canvas Memories name, logo, website design, and all artwork transformations created by our Service are owned by Canvas Memories or our licensors. You may not use our trademarks or copyrighted materials without written permission.

You retain ownership of your original photos. The transformed artwork is created for your personal use. Commercial use of the transformed artwork requires written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANVAS MEMORIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid for your order.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
